Consequences of Being on the California Sex Offender Registry

California’s Megan’s Law requires those individuals convicted of certain sex crimes to register as sex offenders with their local law enforcement agency.

Most registered sex offenders must update their information annually, although some must do so more often- depending on their housing status and the nature of their crime. The Sex Offender Tracking Program monitors the updates and notes on the listing when offenders have missed a required update.

Not every offender’s information appears on the website. Again, the nature of the offender’s crime determines this. In the State of California, for example, juvenile sex offenders do not show up on the Megan's Law website. Up to 20% of all those convicted of a sex crime in California will not show up on the website. This could be due to the nature of their crime, the age at which the crime was committed, and other factors.

When the public has access to the names, addresses, and pictures of registered sex offenders, it creates a dangerous social stigma that can turn into societal prejudice against those convicted. This can make it difficult for those individuals to obtain housing, employment, or even readjust into society.

Failure to Register as a Sex Offender

If you fail to register as a sex offender or you fail to comply with yearly registration or update law enforcement when you move, you could face the following penalties and consequences:

  • Up to 1 year in jail if your sex crime conviction was a misdemeanor
  • Up to 3 years in California State Prison if your sex crime conviction was a felony
  • Possible strike on your record
