Understanding Search and Seizure Laws
Under the U.S. Constitution, you have a right to be free from unreasonable searches and seizures. Any police search must be supported by probable cause, and a search warrant executed against you must describe the place to be searched and the things to be seized.
If we can show that evidence against you was obtained by an illegal search or seizure, it is inadmissible in court and cannot be used to convict you of a crime.
This applies in cases where you are asked to consent to a voluntary search and also cases where you are searched involuntarily based on a search warrant. In either situation, the police must follow certain steps before they are allowed to search you and seize evidence.
Taking the Right Steps to Protect Your Rights
If you have been arrested for a drug crime or any other crime based on evidence obtained during a search, I will get as much information as possible about how the search was conducted and see whether there is an opportunity to suppress the evidence.
The police regularly make mistakes during traffic stops, searches and arrests. They are also sometimes overzealous in their pursuit of evidence and may not always have probable cause to get a search warrant.
